These Terms and Conditions govern access to and use of the website www.hercwear.eu and the purchase of products offered. Please read them carefully before making any purchase.

2. DEFINITIONS

Customer: the User who purchases one or more products through the Site.
General Conditions: these Terms and Conditions, which govern the contractual relationship between HERC and the Customer.
Products: clothing items, accessories, and any other item sold by HERC on the site.

3. SCOPE OF APPLICATION

3.1. These General Conditions apply to all sales of Products made through the Site.
3.2. HERC reserves the right to modify these Terms and Conditions at any time, without prior notice. In such a case, a new version will be published on the Site, which will be effective for purchases made after the publication date.
3.3. By making a purchase on the Site, the Customer declares to have read, understood, and fully accepted these General Conditions.

4. SITE REGISTRATION

4.1. To place orders on the Site, it is advisable (but not mandatory) to register, creating a personal account.
4.2. During registration, the Customer undertakes to provide truthful and complete information. The Customer is responsible for the security of their access credentials and for all activities carried out using them.
4.3. The Customer undertakes to promptly notify HERC of any unauthorized use of their credentials or any other security breach.

5. PRE-CONTRACTUAL INFORMATION

5.1. Before concluding the purchase, the Customer can verify the final price of each product (including VAT and shipping costs, if applicable).
5.2. The images and descriptions on the Site are for illustrative purposes only. The actual characteristics (e.g., color, material, fit) may vary slightly, especially depending on monitor settings or in the case of particular fabric treatments.

6. CONCLUSION OF THE CONTRACT

6.1. The order submitted by the Customer constitutes a contractual proposal and implies complete knowledge and full acceptance of these Terms and Conditions.
6.2. The correct receipt of the order is confirmed by HERC by sending an automatic email ("Order Confirmation"). This confirmation includes the details of the purchase.
6.3. The sales contract is concluded when the Customer receives the order confirmation. If HERC does not confirm the order for any reason, the order is considered rejected and no amount will be charged.

7. PRICES AND AVAILABILITY

7.1. All prices indicated on the Site are expressed in Euros (€) and include VAT, unless otherwise specified.
7.2. Product availability may vary in real time. In case of unavailability of one or more items after the order is placed, HERC will promptly notify the Customer of the unavailability and will proceed, if already paid, with a total or partial refund.

8. PAYMENT METHODS

8.1. HERC offers various payment methods, such as credit card (Visa, Mastercard, etc.), PayPal, bank transfer, cash on delivery (where available), or other methods indicated on the Site.
8.2. If the payment fails or is refused, the order will be canceled.

9. SHIPPING AND DELIVERY

9.1. HERC ships Products to the address indicated by the Customer during the purchase.
9.2. Delivery times vary depending on the destination, product availability, and courier operations.
9.3. In case of delays not attributable to HERC (e.g., force majeure, holiday periods, courier strikes, adverse weather conditions), the Customer cannot claim compensation.
9.4. If a package is returned to the sender due to an incorrect address or failure to collect, the cost of a second shipment will be borne by the Customer.

10. RETURN AND REFUND POLICY

10.1. The Customer has the right to withdraw from the purchase within 7 days of delivery, according to the conditions indicated in our Refund Policy.
10.2. Return shipping costs are borne by the Customer, unless otherwise agreed or in cases of error attributable to HERC (e.g., defective product or product shipped by mistake).
10.3. The Product must be returned intact, with all original labels, unworn and unwashed, except for trying it on. Once the integrity is verified, HERC will proceed with the refund within the prescribed terms.

11. LEGAL GUARANTEE OF CONFORMITY

11.1. All products sold on the Site are covered by the legal guarantee of conformity provided for by articles 128 et seq. of the Consumer Code (Legislative Decree 206/2005).
11.2. The guarantee covers conformity defects found within 24 months from the delivery date.
11.3. To enforce the guarantee, the Customer must report the defect within 2 months of its discovery and must provide proof of purchase (e.g., invoice or receipt).
11.4. In case of a conformity defect, the Customer has the right to have the goods restored to conformity free of charge, by repair or replacement, or to an appropriate reduction in price or termination of the contract, in the cases provided by law.

12. LIABILITY

12.1. HERC will not be liable for any damages resulting from improper or non-conforming use of the Products.
12.2. In no event shall HERC be liable for indirect, incidental, or consequential damages, including loss of data or lost profits, unless caused by willful misconduct or gross negligence.
12.3. HERC does not guarantee that the Site will be uninterrupted or error-free, nor that any defects will be corrected or that the Site or the server are free of viruses or other potentially harmful components.

13. USER OBLIGATIONS

13.1. The User undertakes to provide truthful and accurate information and not to use the Site for illicit or unauthorized purposes.
13.2. The User assumes responsibility for any content entered or shared through the Site, guaranteeing not to infringe third-party rights (e.g., copyright, trademarks).
13.3. If HERC finds fraudulent behavior or violations of these Terms and Conditions, it reserves the right to suspend or terminate the User's access to the Site at any time.

14. INTELLECTUAL PROPERTY

14.1. All content on the Site, including trademarks, logos, images, texts, videos, graphics, software, and databases, are the property of HERC or its licensors and are protected by intellectual and/or industrial property laws.
14.2. Reproduction, modification, distribution, or any other use of the content of the Site without the prior written consent of HERC is prohibited.

15. PRIVACY AND COOKIES

15.1. The processing of personal data takes place in accordance with current legislation (GDPR – EU Regulation 2016/679 and Legislative Decree 196/2003 and subsequent amendments).

16. FORCE MAJEURE

16.1. HERC cannot be held responsible for the total or partial non-fulfillment of its obligations if such non-fulfillment is due to force majeure events, such as natural disasters, governmental actions, strikes, pandemics, wars, etc.
16.2. In such cases, the execution of the contract will be suspended for the duration of the force majeure event. If the impediment lasts for more than 30 days, either party may withdraw from the contract without any compensation being due.

17. APPLICABLE LAW AND JURISDICTION

17.1. These Terms and Conditions are governed by Italian law.
17.2. For any dispute relating to the execution or interpretation of these Terms and Conditions, the consumer court will have exclusive jurisdiction as provided by the Consumer Code (if the Customer is a consumer).

18. ONLINE DISPUTE RESOLUTION (ODR)

18.1. In accordance with Regulation (EU) No. 524/2013, if you are a consumer residing in the EU, you can use the ODR (Online Dispute Resolution) platform for out-of-court resolution of disputes relating to online sales contracts.
